Terms of use
1. About these terms
These terms are an agreement between you and Creatively Apps Limited, registered in England and Wales (company number 17537980), 80 Cramptons Road, Sevenoaks TN14 5DY (“we”, “us”). They cover the Wordway app and website (the “Game”). By downloading or playing the Game you agree to them. If you don’t agree, please don’t use the Game.
If you downloaded the Game from the Apple App Store or Google Play, their terms also apply. Apple and Google aren’t parties to these terms and aren’t responsible for the Game. For iOS, Apple’s Licensed Application End User License Agreement applies unless these terms say otherwise.
2. Your licence to play
We give you a personal, non-exclusive, non-transferable, revocable licence to install the Game on devices you own or control and to play it for your own non-commercial entertainment. You must not:
- copy, modify, reverse-engineer or resell the Game or its content, except where the law allows you to
- use cheats, bots, exploits or anything that interferes with the Game, its ads or its purchases
- use the Game unlawfully or in a way that could harm us or other people
The Game, including its puzzles, artwork, sounds and code, belongs to us or our licensors.
3. Age
The Game is for a general audience. If you are under 18, please make sure a parent or guardian is happy for you to play and to make any purchases.
4. Coins and other virtual items
- Coins, hints and other virtual items can only be used in the Game. They have no real-world value and can’t be exchanged for money or transferred to anyone else.
- You get a licence to use virtual items. You don’t own them.
- We may change how virtual items work (for example what a hint costs) to keep the Game balanced. We won’t take away items you’ve bought without good reason, and if we do, we’ll offer a fair remedy.
- Your progress and coins are stored on your device. If you delete the Game or lose your device, they may be lost. Purchases that are permanent, such as “Remove ads”, can be restored with Restore purchases. Coins can’t be restored through the store, but they are included in your cloud save if you use it.
Cloud save
Cloud save is optional and free. You sign in with a code sent to your email. Please use an email address you control and keep your codes to yourself. We’ll do our best to keep your backup safe, but it’s provided as a convenience and we can’t guarantee it will always be available. You can delete your cloud save and account in Settings at any time.
5. Purchases
- Purchases are processed by Apple or Google under their terms. Prices are shown in the store before you buy and include any VAT that applies.
- Coins are delivered immediately. By confirming the purchase you ask us to supply the digital content straight away, and you agree that you lose your 14-day right to cancel once delivery starts.
- Refunds are handled by Apple (reportaproblem.apple.com) or Google Play (via your order history) under their policies.
- Nothing in these terms affects your statutory rights. Under the UK Consumer Rights Act 2015, digital content must be as described, fit for purpose and of satisfactory quality. If it isn’t, contact us and we’ll put it right, or you may be entitled to a refund.
6. Ads
The Game is free to play and funded by ads. Ad breaks appear between levels, following the rules on our website. Reward videos are optional. Ads are provided by third parties, and we aren’t responsible for the content of ads or third-party websites they link to. See our privacy policy for how ads use data and how to change your choices.
7. Changes and availability
We may update the Game to add content, fix problems or meet legal requirements. Some updates may be needed to keep playing. We try to keep the Game available but can’t promise it will always be uninterrupted or error-free. If we ever permanently close the Game, we’ll give reasonable notice where we can.
8. Our responsibility to you
- If we fail to follow these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or negligence. We aren’t responsible for loss or damage that isn’t foreseeable.
- We don’t exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, and for breach of your statutory consumer rights.
- The Game is for personal entertainment. We aren’t responsible for any loss of profit, business or business opportunity.
- If digital content we supply damages your device or other digital content because we didn’t use reasonable care and skill, we will repair the damage or compensate you.
9. Ending your use
You can stop playing at any time by deleting the Game. We may suspend or end your licence if you seriously break these terms, for example by cheating or tampering with purchases.
10. Changes to these terms
We may update these terms, for example to reflect new features or legal changes. We’ll update the date above and, for important changes, tell you in the Game. If you keep playing after a change takes effect, the new terms apply.
11. Law and disputes
These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings there. If you live in the EU, you also keep the protection of the mandatory consumer laws of your country.
